However, access to technological tools of such magnitude inevitably entails a proportional legal and ethical responsibility.
To ensure that Mindrift remains a safe, respectful, healthy digital ecosystem that strictly complies with international legislation, we have established these comprehensive and stringent Community Guidelines. By creating an account and utilizing our Service, you formally agree to comply with these rules of conduct without any exception or reservation. Violations of these provisions will not be tolerated. Enforcement is strict, managed by automated analysis systems, and systematically verified by specialized human moderators.
2. Strictly Prohibited Content Categories
You are explicitly, expressly, and strictly forbidden from generating, attempting to generate, hosting, disseminating, or sharing any content (whether through complex text prompts or image inputs via the image-to-image functionality) that falls into the tortious and criminal categories detailed below:
A. Child Sexual Abuse Material (CSAM) and Exploitation
Absolute Zero Tolerance Policy. Any generation, or attempt to generate, content depicting minors, whether real or fictitious, in sexual, suggestive, degrading, or exploitative contexts constitutes a severe crime under international laws. Mindrift deploys advanced perceptual hashing algorithms and semantic safety filters to proactively detect any attempt.
Inflexible Consequence: Immediate, irrevocable, and permanent ban, complete forfeiture of any remaining wallet balance, and automatic and systematic transmission of your account details, IP address, prompts, and connection logs to the National Center for Missing & Exploited Children (NCMEC), Europol, Interpol, and relevant local law enforcement agencies.
B. Non-Consensual Deepfakes, Identity Theft, and Privacy Violations
You are in no way authorized to generate compromising, defamatory, sexually explicit, or maliciously deceptive imagery involving real, identifiable, living individuals. This absolute prohibition encompasses public figures, politicians, celebrities, as well as private citizens. Using Mindrift for creating non-consensual intimate imagery (NCII), identity theft, CEO fraud, targeted harassment, doxxing, or blackmail (sextortion) constitutes a critical violation of these Terms and is subject to immediate criminal prosecution.
C. Extreme Violence, Hyperrealistic Gore, and Incitement to Self-Harm
The creation of content gratuitously and hyperrealistically depicting extreme violence, dismemberment, blood, physical or psychological torture, war crimes, or animal cruelty is strictly banned from the platform. Furthermore, the generation of content aimed at promoting, encouraging, glorifying, or providing instructions for suicide, self-harm, eating disorders (anorexia, bulimia), or any other form of harm to physical integrity is explicitly forbidden. Our mission is to catalyze artistic expression, not to host the glorification of suffering.
D. Hate Speech, Systemic Harassment, and Violent Extremism
Mindrift categorically refuses to be weaponized as a vector for harassment, propaganda, or radicalization. It is strictly prohibited to generate visual elements glorifying or promoting hate speech, systemic discrimination, dehumanization, or physical and psychological violence against a protected group (based on criteria such as race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender identity, disability, or serious disease). Any content symbolizing, promoting, or supporting recognized terrorist organizations, dangerous cults, or violent extremist groups will lead to immediate eviction.
E. Deliberate Counterfeiting and Intellectual Property Infringement (Copyright/Trademarks)
Although the very nature of AI generation involves the fusion and reinterpretation of various artistic styles, you are strictly prohibited from exploiting the Service to deliberately, massively, and automatically produce exact replicas or blatant counterfeits of copyrighted works, proprietary licensed characters, or registered corporate logos. Any attempt to infringe upon the intellectual property rights of third parties or to pass off generated content as an official and original commercial product will be penalized by the removal of the offending content and potential restrictive measures on your account.
3. Behavioral Rules and Infrastructure Integrity Preservation
In addition to severe restrictions on the nature of generated content, your technical behavior on the platform must respect the integrity of our software and hardware infrastructure:
- No Jailbreaking or Circumvention: Any active, systematic, or repeated attempt to bypass, deceive, disable, reverse-engineer, or "jailbreak" our safety filters using adversarial prompting techniques or semantic obfuscation constitutes a direct contractual violation.
- No Automated Scraping: The use of automated tools, bots, web crawlers, scraping scripts, or browser extensions to harvest, download, or mass-extract generated images, prompt histories, or data belonging to other users from the platform is expressly prohibited.
- No Spam/DDoS Attacks: Using our public API or web interface to flood our systems with thousands of consecutive low-quality requests designed with the manifest intent to saturate bandwidth, exhaust GPU resources, or cause a denial of service (DDoS) will result in an immediate IP block.
4. Proactive Moderation Mechanisms and Sanction Matrix
Mindrift has engineered and deployed a sophisticated, multi-layered hybrid moderation pipeline that combines the speed of specialized risk-detection AI classifiers (NSFW, toxicity) with the nuance and ethical judgment of dedicated human review teams.
Progressive Sanction Matrix for Violations
Depending on the nature, severity, frequency, and intentionality of the observed violation, our moderation team will apply, at its sole discretion, one or more of the following sanctions:
- 1. Formal Warning and Content Removal: For minor infractions or accidental triggering of our safety filters (false positives due to ambiguous wording), the specific image will be promptly deleted, and an official warning will be recorded in your account file.
- 2. Temporary Suspension (Shadowban / Cooldown): Repeated minor offenses or conduct demonstrating disregard for previous warnings will result in a temporary lock on your generation capabilities, the duration of which (from 24 hours to several weeks) will be determined by our moderators.
- 3. Permanent and Irrevocable Ban (Permaban): Severe violations (such as creating deepfakes, glorifying extreme violence, targeted harassment, or sophisticated attempts to bypass safety filters) will result in an immediate, definitive ban without possibility of appeal. Your account will be destroyed, and any remaining wallet balance will be permanently forfeited without refund.
- 4. Legal and Criminal Escalation: As previously stated, generating or attempting to generate content that constitutes a serious criminal offense will trigger a proactive and immediate report to relevant national and international law enforcement agencies.
5. Appeals and Community Reporting
Appeals Process: If you believe in good faith that your account was unjustly suspended or a creation was censored due to an error in our automated filters (a false positive), you have the right to file a reasoned appeal from your console settings or by contacting our ethics and moderation team at [email protected]. Appeals are reviewed manually on a case-by-case basis. However, please note that the decision rendered by our teams following this review is final and unappealable.
Reporting Violations: Maintaining a safe environment also relies on our community's vigilance. If you witness public images or users deliberately violating these Guidelines, we urge you to immediately use the in-app "Report" button or send us a detailed email. All reports are handled strictly confidentially and diligently.
